COLUMBIA, S.C. (AP) - A Lexington attorney accused of extorting more than $1 million from clients has waived his right to have a court hearing on his mental competency.

Richard Breibart made that decision in court papers filed this week.

Breibart is scheduled for trial later this summer on charges of extortion, mail fraud and wire fraud. His attorney has said Breibart may have been insane at the time of his alleged crimes and might not be able to help in his own defense.

Last year, a judge ordered Breibart to have a mental evaluation.

Indictments list three people who allegedly cleaned out bank accounts, investments and retirement savings to give to Breibart. Prosecutors say he got money from clients by threatening them with criminal charges or non-existent civil penalties.
